Terms & Conditions

The services are provided by TripPilot, a company located in USA. The terms "we", "us", "our" shall be construed accordingly.
By creating a TripPilot account, you agree to be bound by the terms, conditions, and notices set forth below (collectively, this "agreement"). This agreement does not apply if you merely browse the websites or use the services without creating a TripPilot account. Please read this agreement carefully, as it contains information concerning your legal rights and limitations on these rights, as well as a section regarding applicable law and jurisdiction of disputes. If you are a consumer in the EU or UK, you have a legal right to withdraw from this agreement within 14 days of the agreement being made. You can do this, or terminate this agreement at any other time, by closing your account and no longer accessing or using the services.
If you are a consumer in the EU or UK, you will have certain mandatory consumer rights. If you are a consumer living elsewhere, you may also have consumer rights under the laws of your territory. Nothing in this agreement affects your mandatory consumer rights.
Any information, text, links, graphics, photos, audio, videos, data, code, or other materials or arrangements of materials that you can view on, access, or otherwise interact with through the services shall be referred to as "content." "services" as defined above refers to those provided by TripPilot or our corporate affiliates. For the avoidance of doubt, the websites are all owned and controlled by TripPilot. However, some specific services made available via the websites may be owned and controlled by TripPilot’s corporate affiliates, for example, services facilitating the booking of holiday rentals, restaurant reservations, and experiences with third-party suppliers. As part of our services, we may send you notifications about special offers, products, or additional services available from us, our affiliates, or our partners, that may be of interest to you. Such notifications will typically be sent through newsletters and marketing communications and represent efforts to get to know you and your preferences better across our services and those of our affiliates. In turn, this enables the customization of the services in line with those preferences.
The term "you" or "user" refers to the individual, company, business organization, or other legal entity which has created a TripPilot account and uses the services and/or contributes content to them. The content that you contribute, submit, transmit, and/or post to or through the services shall be referred to variously as "your content", "content of yours", and/or "content you submit."
The services are provided on an ongoing basis, and are provided solely to:
  • Assist users in gathering travel information, posting content, and searching for and booking travel services and reservations; and
  • Assist travel, tourism, and hospitality businesses in engaging with users and potential customers, by way of free and/or paid-for services offered by or through TripPilot.
Products, services, information, and content on our services change regularly, so that it is up to date (for example, with current information and offers). This means, for example, that in respect of third-party services, new transportation services, accommodations, restaurants, tours, activities, or experiences may become available for you to book while other services may become unavailable. We may change or otherwise modify this agreement in the future in accordance with the terms and conditions herein, and you understand and agree that your continued access or use of the services after such change signifies your acceptance of the updated or modified agreement. We will note the date that revisions were last made to this agreement at the bottom of this agreement, and any revisions will take effect upon posting. We will notify you of material changes to these terms and conditions by either sending a notice to the email address associated with your profile or by placing a notice on our websites. Be sure to return to this page periodically to review the most current version of this agreement. If you don't want to accept any changes to this agreement, you may close your account and cease to access the services (a description of how to do so is available here).
Use of the Services
As a condition of your use of the services, you agree that (i) all information supplied by you via the services to TripPilot is true, accurate, current, and complete, (ii) you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you, (iii) you are 13 years of age or older. The company does not knowingly collect the information of anyone under the age of 13. If you are a consumer resident in the EU or the UK, we may deny you access to the services if you violate this agreement, or for any other reasonable cause. If you are not a consumer resident in the EU or the UK, we retain the right at our sole discretion to deny you access to the services, at any time and for any reason, including, but not limited to, for violation of this agreement. By using the services, including any products or services that facilitate the sharing of content to or from third-party sites, you understand that you are solely responsible for any information that you share with TripPilot. You may access the services solely as intended through the provided functionality of the services and as permitted under this agreement.
Copying, transmission, reproduction, replication, posting, or redistribution of (a) content or any portion thereof and/or (b) the services more generally is strictly prohibited without the prior written permission of cc.
In order to access certain features of the services, you will need to create an account. When you create an account, you must provide complete and accurate information. You are solely responsible for the activity that occurs on your account, including your interaction and communication with others, and you must safeguard your account. Towards this end, you agree to keep your contact information up to date.
If you are creating a TripPilot account for commercial purposes and are accepting this agreement on behalf of a company, organization, or other legal entity, you agree that you are authorized to do so and have the authority to bind such entity to this agreement, in which case the words “you” and “your” as used in this agreement shall refer to such entity and the individual acting on behalf of the company shall be referred to as a “Business Representative”.
Through your use of the services, you may encounter links to third-party sites and apps or be able to interact with third-party sites and apps. This may include the ability to share content from the services, including your content, with such third-party sites and apps.
Please be aware that third-party sites and apps may publicly display such shared content. Such third parties may charge a fee for use of certain content or services provided on or by way of their websites. Therefore, you should make whatever investigation you feel is necessary or appropriate before proceeding with any transaction with any third party to determine whether a charge will be incurred. Where TripPilot provides details of fees or charges for such third-party content or services, such information is provided for convenience and information purposes only. Any interactions with third-party sites and apps are at your own risk. You expressly acknowledge and agree that TripPilot are in no way responsible or liable for any such third-party sites or apps.
TripPilot ranks and presents listings to you using recommender systems. Different categories of listings (such as hotels and restaurants, things to do and flights) are ranked based on different criteria, such as price, "traveller favourites" and duration.
Some content you see or otherwise access on or through the services is used for commercial purposes. You agree and understand that TripPilot may place advertising and promotions on the services alongside, near, adjacent, or otherwise in close proximity to your content (including, for video or other dynamic content, before, during, or after its presentation), as well as the content of others.
Additional Products
TripPilot may, from time to time, decide to change, update or discontinue certain products and features of the services. You agree and understand that TripPilot has no obligation to store or maintain your content or other information you provide, except to the extent required by applicable law.
We also offer other services that may be governed by additional terms or agreements. If you use any other such services, the additional terms will be made available and will become part of this agreement, except where such additional terms expressly exclude or otherwise supersede this agreement. For example, if you use or purchase such additional services for commercial or business purposes, you must agree to the applicable additional terms. To the extent any other terms conflict with the terms and conditions of this agreement, the additional terms shall govern to the extent of the conflict with respect to those specific services.
Prohibited Activities
The content and information available on and through the services (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code or other material), as well as the infrastructure used to provide such content and information, is proprietary to TripPilot or licensed to TripPilot by third parties. For all content other than your content, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell or re-sell any information, software, products, or services obtained from or through the services. Additionally, you agree not to:
  • Use the services or content for any commercial purpose, outside the scope of those commercial purposes explicitly permitted under this agreement and related guidelines as made available by TripPilot.
  • Access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy or otherwise exploit any content of the services, including but not limited to, user profiles and photos, using any robot, spider, scraper or other automated means or any manual process for any purpose not in accordance with this agreement or without our express written permission.
  • Violate the restrictions in any robot exclusion headers on the services or bypass or circumvent other measures employed to prevent or limit access to the services.
  • Take any action that imposes, or may impose, in our sole discretion (or, if you are a consumer resident in the UK or EU, in our reasonable discretion), an unreasonable or disproportionately large load on our infrastructure.
  • Deep-link to any portion of the services for any purpose without our express written permission.
  • “Frame", "mirror" or otherwise incorporate any part of the services into any other websites or service without our prior written authorization.
  • Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software programs used by TripPilot in connection with the services.
  • Circumvent, disable or otherwise interfere with security-related features of the services or features that prevent or restrict use or copying of any content.
  • Download any content unless it’s expressly made available for download by TripPilot; or
  • (x) use, or assist, encourage, or enable any third-party to use, any robot, spider, artificial intelligence (AI) system, or other automated device, process or means to access, retrieve, copy, scrape, aggregate, collect, download, or otherwise index any portion of the services or any content, except as expressly permitted by TripPilot in writing.
Protecting Your Privacy
At TripPilot, your privacy is of paramount importance, and we adhere strictly to data protection laws at all times. By using our services and platforms, you acknowledge that any personal data you provide, as outlined in our privacy policy, may be utilized by us in accordance with the same. You commit to supplying accurate and current personal data and confirm that you possess all necessary consents, licenses, or approvals required for us to use that information in accordance with these terms, our community guidelines, and our privacy policy.
Regarding any information, images, video, or other data you may post, upload, transmit, or make available through our services or platforms in USA (“user content”), you agree to the following:
  • You are solely responsible for the user content you upload. You assert that you will not share anything without the necessary permissions or rights, nor will you share anything for which you cannot grant the license described below.
  • While you retain all intellectual property rights in any user content, and are free to share it elsewhere, you grant TripPilot and its affiliate companies a non-exclusive, perpetual, royalty-free, worldwide, transferable, and sublicensable right to host, use, reproduce, publicly display, distribute, modify, adapt, publish, translate, and create derivative works from any such user content. This is for purposes including but not limited to advertising and marketing our services and platforms. For instance, we may allow our business partners or other TripPilot companies to display your user content on their sites. You maintain control of the user content you upload and can terminate this license at any time by deleting the user content or your TripPilot account. Deleted user content will be promptly removed within 48 hours.
  • We are not obliged to store, retain, publish, or make available any user content you upload, and you are responsible for creating backups of your user content.
  • If you provide any suggestions, comments, improvements, ideas, or other feedback (“feedback”), you irrevocably assign all intellectual property rights in that feedback to us. You acknowledge that we may use and share such feedback for any purpose at our discretion.
Price Accuracy and Warranty Disclaimer
Utilizing the services and Platforms offered by TripPilot is entirely at your own risk.
TripPilot enforces stringent price accuracy policies with all Travel providers who contribute travel data, striving to ensure that the content presented through our services and Platforms is current and accurate. However, the reliability or precision of such content cannot be guaranteed.
Similarly, our price forecasts are predicated on historical pricing trends data we possess. Despite this, the accuracy of our forecasts is not guaranteed.
TripPilot provides the services and Platforms on an ‘as is’ basis and expressly disclaims all warranties, conditions, and guarantees of any kind, whether express or implied. These include, but are not limited to, implied warranties of title, non-infringement, merchantability, and accuracy, as well as any warranties implied by usage of trade, course of dealing, or course of performance. To the extent permissible by law, we do not represent or warrant that our services or Platforms (a) are accurate, complete, or up-to-date; (b) will always be available; (c) will meet your expectations; or (d) are secure or free from errors, faults, defects, viruses, or malware.
Price Forecasting
TripPilot may provide you with flight forecasting information if you opt-in for price alerts. Our price forecasts represent our best estimates at any given time based on past trends data. However, as pricing and availability depend on third parties, there is no guarantee that our forecasts will be accurate. While you may rely on our forecasts, we do not and cannot guarantee their accuracy and accept no liability for any inaccuracies or unavailability of indicative prices.
Making Travel Bookings via TripPilot
TripPilot is not a travel agent and does not take responsibility for any travel options displayed via our services or platforms nor for setting or controlling the prices we display. Any third-party travel products found and/or booked via our services or platforms are provided by independent travel providers.
TripPilot facilitates your bookings with travel providers but is not liable to you regarding such bookings. The identity of the relevant travel provider and the terms and conditions applicable to your booking with them will be communicated at the time of booking. It is crucial that you read and fully understand these terms before completing your booking.
Linked Travel Arrangements
Utilizing our platforms to book multiple related travel products within a 24-hour period (e.g., a flight and a hotel booked separately but within 24 hours of each other) might be classified as a “Linked Travel Arrangement,” depending on your location and the applicable consumer protection laws. This classification means you may not receive the same level of consumer protection as you would when booking both a flight and hotel together through a single agent (which might offer the benefits applicable to holiday packages). You will need to depend on each individual Travel Provider's performance, with no legal recourse to the package organizer or retailer. Should any provider involved in a Linked Travel Arrangement become insolvent, protections under the EU Package Travel Regulations will not apply.
Limitations and Exclusions of Liability
These Terms delineate the full extent of TripPilot’s obligations and liabilities concerning our services and Platforms.
TripPilot holds no responsibility for any arrangements made with third parties due to the use of our services or platforms (including, without limitation, any travel provider). Should you encounter issues with any booking made or attempted via TripPilot, it is your responsibility to resolve such issues with the relevant travel provider. Your sole remedy in such circumstances, including any refunds, lies with the relevant travel provider and not with TripPilot. We provide links to other sites and resources provided by third parties for your information only and assume no responsibility for them or for any loss or damage that may arise from your use of them.
You may encounter third-party advertising on our services and Platforms. Each advertiser is solely responsible for the content of its advertising material, and TripPilot accepts no responsibility for any errors, omissions, or inaccuracies therein.
To the maximum extent permitted by law, we (together with our officers, directors, employees, representatives, affiliates, providers, and third parties) do not accept any liability for (a) any inaccuracies or omissions in the content displayed on or via our services or platforms; or (b) any act of god, accident, delay, or any special, exemplary, punitive, indirect, incidental, or consequential loss or damage of any kind (including, without limitation, lost profits or lost savings), whether based in contract, tort (including negligence), strict liability, or otherwise, incurred by you arising out of or in connection with your access to, use of, or inability to access or use, our services or platforms.
Subject to these terms and to the extent permitted by law, our maximum aggregate liability to you arising out of or in connection with these terms or your access to, use of, or inability to access or use, our services or platforms shall be limited.
Nothing in these terms shall limit or exclude (a) our liability in respect of death or personal injury caused by our negligence or for our fraud or fraudulent misrepresentation; (b) any other liability that cannot be excluded by law; or (c) your statutory rights.
Your Liability to Us
Subject to these terms, you will be responsible and liable to us for all actions, claims, proceedings, costs, damages, losses, and expenses (including, without limitation, legal fees) incurred by us, and each of our officers, directors, employees, and agents, arising out of or in any way connected with your use of our services or platforms or breach of these terms.
Termination
TripPilot may, in its absolute discretion, immediately terminate any agreement with you under these terms at any time upon notice to you and/or, if you have a log-in account, by cancelling your membership and your access to your account and removing any user content you have uploaded to our services or platforms. TripPilot may suspend your access and use in whole or in part without notice at any time, for example, to prevent you from uploading any user content, without incurring any liability to you whatsoever.
General Provisions
You acknowledge that your unauthorized use of our services or platforms may result in irreparable damage and injury to TripPilot and/or its affiliates or licensors for which money damages would be inadequate. Consequently, in the event of such unauthorized use, we and our affiliates and/or licensors (as applicable) shall have the right, in addition to any other legal remedies available, to seek an immediate injunction against you.
The invalidity or unenforceability of any provision (in whole or part) of these terms shall not affect the validity or enforceability of the remaining provisions (in whole or part). The whole or part of any provision which is held by a court of competent jurisdiction to be invalid or unenforceable shall be deemed deleted from these terms.
These terms are personal to you. You shall not be entitled to assign these terms in whole or in part to any third party without our prior written consent.
These terms represent the entire agreement between us and you and supersede and replace all and any previous terms, conditions, agreements, and arrangements concerning your use of our services or platforms.
We will act promptly to any indications of user content that is in breach of these terms. Where you know of or suspect any illegal activities, please contact us at our helpdesk.
Any failure by us to enforce any of these terms shall not be a waiver of them or limit the right to subsequently enforce any of these terms.
A person who is not a party to these terms shall have no right to enforce any provision of these terms.
Irrespective of the country from which you access or use services or platforms, to the extent permitted by law these terms and your use shall be governed in accordance with the laws of England and Wales, and you are deemed to have submitted to the non-exclusive jurisdiction of the courts of England and Wales to resolve any disputes which may arise hereunder. If you are using the platforms or services for commercial purposes, or via an unauthorized computer program as further described and prohibited under the “using our services” section of these terms, then you submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising hereunder unless there is an existing commercial agreement between us governing your use which specifies otherwise.
Liability Disclaimer
Please read this section carefully as it limits the liability of TripPilot to you for issues that may arise in connection with your use of their services.
The services provided by TripPilot may include information, software, products, and services that contain inaccuracies or errors, including errors in reservation availability and pricing. TripPilot does not guarantee the accuracy of, and disclaims all liability for, any errors or inaccuracies regarding the information and description of hotels, adventures, flights, cruises, dining, or any other travel products listed on the services (including, without limitation, pricing, availability, photos, hotel amenities, product descriptions, reviews, and ratings). Furthermore, TripPilot expressly reserves the right to correct any pricing and availability errors on the services and/or on pending reservations made under an incorrect price.
TripPilot makes no claims regarding the suitability of the services or any content on its websites for any purpose. The inclusion or offering of any products or services does not constitute an endorsement or recommendation by TripPilot, despite any awards given based on customer reviews. All services and products available through TripPilot are provided "as is" without warranty of any kind. To the maximum extent permitted by applicable law, TripPilot disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
TripPilot also denies any warranties regarding the accuracy or exclusivity of the content offered through its services.
Third-party suppliers of hotels, flights, car rentals, experiences, restaurants, or cruises on the services are independent contractors and not agents or employees of TripPilot. TripPilot is not responsible for any acts, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. TripPilot will not be liable for any refunds in the event of delays, cancellations, overbooking, strikes, force majeure, or other uncontrollable events, nor is it responsible for any additional expenses, omissions, delays, or actions of any government or authority.
Fees and Payment
In addition to the booking cost as levied by service providers, TripPilot retains the authority to impose certain fees categorized under service fees. TripPilot also maintains the right to modify any such fees periodically. Before finalizing the booking or processing the payment from such user, any such supplementary fees, including charges related to any modifications thereof, will be prominently displayed.
In instances where there is a discrepancy in charging the full booking amount, including taxes, statutory fees, and convenience fees, due to a technical glitch or other reasons, TripPilot reserves the right to recover the balance from the user, who is obligated to pay the said balance to TripPilot. In situations where the balance is demanded prior to the service utilization, TripPilot holds the discretion to cancel such bookings should the outstanding payments not be settled before the service utilization date.
Should there be an increase in the price imposed by TripPilot due to alterations in tax rates or the introduction of new taxes or levies by the government, such costs must be borne by the user. The enforcement of new taxes or levies might be done without prior notification and could be retrospective but will adhere to prevailing law.
In the exceptional event of a booking not being confirmed for any reason, TripPilot will initiate a refund of the amount paid by the user and notify the user accordingly. TripPilot is not obligated to provide an alternative booking or compensate for the unconfirmed booking. Any new bookings will be considered as separate transactions, and any refunds will be processed following the specific policies of the service provider and TripPilot.
The user is solely accountable for all charges, fees, duties, taxes, and assessments incurred from using the service, in accordance with applicable laws.
It is understood by the user that all payments must only be directed to the official bank accounts of TripPilot. Neither TripPilot nor its agents, representatives, or employees will request transfers to any private or unauthorized accounts. Should the user transfer funds to an account not officially recognized by TripPilot or to a personal account, TripPilot will not assume liability for such actions. The user forfeits the right to reclaim any such amounts transferred to third parties.
The user is advised against sharing personal sensitive information such as credit/debit card numbers, CVV, OTPs, card expiry dates, user IDs, or passwords with anyone, including personnel purportedly representing TripPilot. Should any such information be solicited by TripPilot’s agents, employees, or representatives, it must be reported to TripPilot immediately. TripPilot will not be accountable for losses incurred due to the disclosure of such information.
Refunds on cancellations, where applicable, will be credited back to the original account or payment method used for the transaction.
Bookings made through TripPilot are governed by the cancellation policy displayed on the booking page or communicated to the customers in writing.
Account Information
TripPilot may modify, add, or remove terms of this agreement or any part thereof as it sees fit, at its sole discretion—or in its reasonable discretion for consumers residing in the UK or EU—when deemed necessary for legal, regulatory, or technical reasons, or due to changes in the services offered or their format or nature. By continuing to use the services after such modifications, you agree to be bound by the updated terms.
Modifications:
TripPilot may change, pause, or end any aspect of the services, including the availability of any features, databases, or content, at any time and without cost to you, for reasons including:
  • Compliance with applicable laws or reflecting changes in relevant laws and regulatory requirements, such as mandatory consumer laws;
  • Temporary maintenance, bug fixes, technical adjustments, operational improvements, or adapting the services to new technical environments, transferring the services to a new hosting platform, or ensuring compatibility of the services with updated devices and software;
  • Upgrades or amendments to the services, such as launching new versions of the websites on specific devices, or making modifications to existing features and functionality;
  • Alterations to the structure, design, or layout of the services, including changes in branding, or updates to enhance and expand the functionalities offered;
  • Security enhancements.
    • For UK and EU-based users: Should there be any changes to the services that could materially affect your access or usage, TripPilot will provide at least 30 days' notice. If you continue to use the services after these changes take effect, it will be taken as your acceptance of the new terms.
Updates:
TripPilot will implement updates to ensure the services comply with applicable consumer laws. If your settings allow for automatic updates, these will be applied automatically. You can modify your settings anytime to stop receiving updates automatically.
To optimize your experience and ensure proper functionality of the services, it is recommended to accept updates as they are offered. This may require updating your device's operating system. As new devices and operating systems are released, support for older versions may cease.
If you opt not to install updates, you may lose access to the services, support, or previous functionalities.
TripPilot is not liable for any consequences stemming from your failure to install updates or the latest version of the services, especially when you have been informed about the updates and given installation instructions.
Any modifications not described under this "Updates" section will be governed by the "Modifications" section above.
Termination:
TripPilot reserves the right to limit or restrict your access to all or parts of the services without notice or liability for technical or security reasons, to prevent unauthorized access or data loss, or if TripPilot, at its sole discretion—or reasonable discretion for UK or EU consumers—believes you have violated any terms of this agreement or any law or regulation, or decides to discontinue any part of the services.
TripPilot may terminate this agreement at any time, without prior notice, if it reasonably believes that you have breached this agreement or if such termination is deemed necessary to protect the rights of TripPilot and/or other users of the services. This means that the provision of services to you may be discontinued.
